Kellemen Inc ("Kellemen," "we," "us") operates kellemen.com. This policy explains what we collect, why, who we share it with, and the choices you have.

WHAT WE COLLECT

Information you give us

- Order information: name, shipping and billing address, email, phone, and payment details. Payment card numbers are processed by Shopify Payments and its providers; we never see or store your full card number.
- Account and subscription information: Performance Club preferences, delivery schedule, and order history.
- Communications: emails you send us, reviews you submit, and survey or quiz answers.
- Marketing sign-ups: your email or phone number when you subscribe.

Information collected automatically

- Device and usage data: IP address, browser type, pages viewed, time on site, referring URLs, and how you interact with the site, collected through cookies, pixels, and similar technologies.

HOW WE USE IT

- To process and deliver orders, manage Performance Club subscriptions, and send order and shipping updates.
- To provide customer support and honor our guarantee.
- To send marketing emails and texts you've opted into (you can unsubscribe any time).
- To measure and improve the site, our products, and our advertising.
- To detect fraud and protect our customers and business.
- To comply with legal obligations.

WHO WE SHARE IT WITH

We share personal information with service providers who help us run the business, only as needed for the service they provide:

- Shopify — store platform and payments
- Loop Subscriptions — Performance Club subscription management
- Klaviyo — email and SMS marketing
- Okendo — product reviews
- Shipping carriers and fulfillment partners — delivery
- Analytics and advertising partners — including Meta (Facebook/Instagram), TikTok, X, Google, and Microsoft Clarity, which use cookies and pixels to measure site activity and show you relevant ads on their platforms. These partners may combine this data with information they hold about you under their own privacy policies.

We don't sell your personal information for money. Some advertising cookies may be considered a "sale" or "sharing" under California law; see Your California Rights below for how to opt out.

We may also disclose information if required by law, to enforce our terms, or as part of a merger, acquisition, or sale of assets.

COOKIES AND TRACKING

We use cookies and pixels for site function, analytics, and advertising. You can control cookies through your browser settings. For advertising opt-outs, visit the Digital Advertising Alliance at optout.aboutads.info, or adjust ad settings directly in your Meta, TikTok, X, and Google accounts. Blocking cookies may affect site functionality.

MARKETING EMAILS AND TEXTS

You'll only receive marketing from us if you opt in. Every email has an unsubscribe link. Reply STOP to any text to opt out of SMS. Message and data rates may apply. Opting out of marketing doesn't stop transactional messages about your orders or subscription.

YOUR CALIFORNIA RIGHTS (CCPA/CPRA)

If you're a California resident, you have the right to:

- Know what personal information we collect and how we use and share it.
- Delete personal information we hold about you, subject to legal exceptions.
- Correct inaccurate personal information.
- Opt out of the sale or sharing of personal information for cross-context behavioral advertising.
- Limit use of sensitive personal information (we don't collect sensitive personal information as defined by the CPRA).
- Non-discrimination for exercising these rights.

To exercise these rights, email welcome@kellemen.com with the subject "Privacy Request" or write to us at [MAILING ADDRESS]. We'll verify your identity using the information on your account. You may use an authorized agent; we'll ask for proof of authorization. To opt out of sale/sharing, you may also use the cookie controls above or send a Global Privacy Control signal from your browser, which we honor.

Residents of other states with privacy laws (including Colorado, Connecticut, Virginia, Utah, Texas, and Oregon) may have similar rights and can use the same contact methods.

DATA RETENTION

We keep order and account information for as long as needed to serve you, meet legal and tax obligations (generally seven years for transaction records), and resolve disputes. Marketing data is kept until you unsubscribe or ask us to delete it.

SECURITY

We use industry-standard safeguards, including encryption in transit and Shopify's PCI-compliant payment infrastructure. No system is perfectly secure, and we can't guarantee absolute security.

CHILDREN

Kellemen.com is not directed to anyone under 16, and we don't knowingly collect personal information from children.

CHANGES

We'll post updates here with a new "last updated" date. Material changes will be announced by email or a site notice.
