These terms govern your use of kellemen.com and your purchases from Kellemen Inc ("Kellemen," "we," "us"). By using the site or placing an order, you agree to them.

1. ELIGIBILITY

You must be at least 18 years old, or the age of majority in your state, to place an order.

2. PRODUCTS, PRICING, AND AVAILABILITY

- Prices are in U.S. dollars and can change without notice, but the price you see at checkout is the price you pay.
- Sale and promotional prices apply only during the stated promotion period. "Value" and strikethrough prices reflect the regular price of the items sold individually plus, where stated, the standard shipping charge that is waived.
- We do our best to display products accurately. Colors, scent descriptions, and packaging may vary slightly.
- We reserve the right to limit quantities, cancel orders that appear fraudulent or made by resellers, and correct obvious pricing errors. If we cancel an order, you'll get a full refund.
- Products are intended for personal use as directed. Discontinue use if irritation occurs. Our products are not intended to diagnose, treat, cure, or prevent any disease.

3. ORDERS AND PAYMENT

Placing an order is an offer to buy. We accept it when we ship. You authorize us to charge your payment method for the order total shown at checkout, including any applicable tax and shipping.

4. PERFORMANCE CLUB SUBSCRIPTION TERMS

Automatic renewal. The Performance Club is an automatically renewing subscription. When you choose Performance Club at checkout, you authorize Kellemen to charge your payment method on a recurring basis at the interval and price shown at checkout until you cancel.

What you agree to at signup

- Price: Performance Club members pay 15% off the regular price of each product (currently $15.30 per Performance Deodorant and $24.65 per Body Fuel, plus applicable tax). Introductory offers (such as the Warm-Up Set) show the first-box price and the renewal price and contents at checkout.
- Frequency: Your delivery interval is based on how many products are in your box (for example, every 45 days for one stick; every 3 months for two) and is shown at checkout and in your account.
- Billing: Your payment method is charged on each renewal date, roughly when your next box is scheduled. We email you 3 days before each renewal processes.
- Shipping: Free on Club orders of $30 or more; otherwise $8.00.

Changing, pausing, skipping, or cancelling. You can skip a delivery, change your date or frequency, swap scents, pause, or cancel any time from your Performance Club account at kellemen.com/a/loop_subscriptions/customer, or by emailing welcome@kellemen.com. Cancellation is immediate and there is no cancellation fee. Changes made before a renewal processes apply to that renewal; changes made after apply to the following one. Renewal orders that have already processed follow our Refund Policy.

Price changes. If we change the regular price of a product, we'll email you at least 30 days before the new price applies to your renewals, and you can cancel before it takes effect.

Failed payments. If a renewal charge fails, we'll retry and notify you. If payment can't be collected, we'll pause your subscription until you update your payment method.

5. DISCOUNT CODES AND PROMOTIONS

One code per order unless stated otherwise. Codes can't be applied retroactively, may exclude subscription renewals, and may be withdrawn at any time. Abuse of promotions may result in order cancellation.

6. REVIEWS AND USER CONTENT

By submitting a review, photo, or comment, you grant Kellemen a non-exclusive, royalty-free, perpetual license to use, edit, and display it in connection with our business, including on our site, social media, and advertising. Submit only honest content based on your own experience. We may remove content at our discretion. If you received free product or compensation, disclose it in your review.

7. INTELLECTUAL PROPERTY

The Kellemen name, logo, product names, scent names, formulas, copy, photos, and site design are owned by Kellemen Inc or our licensors. You may not use them without written permission.

8. ACCEPTABLE USE

Don't use the site to break any law, interfere with its operation, scrape it, or attempt to access accounts or data that aren't yours.

9. DISCLAIMERS

The site and products are provided "as is." To the fullest extent permitted by law, we disclaim all warranties, express or implied, other than those stated in our Refund Policy. Nothing in these terms limits rights you have under applicable consumer protection law.

10. LIMITATION OF LIABILITY

To the fullest extent permitted by law, Kellemen's total liability for any claim arising from a purchase is limited to the amount you paid for the order at issue. We're not liable for indirect, incidental, or consequential damages.

11. INDEMNIFICATION

You agree to indemnify Kellemen against claims arising from your breach of these terms or misuse of the site.

12. DISPUTES AND GOVERNING LAW

These terms are governed by the laws of the State of California, without regard to conflict-of-law rules. Before filing any claim, you agree to contact us at welcome@kellemen.com and give us 30 days to try to resolve it informally. Any dispute that isn't resolved will be brought in the state or federal courts located in California, and you consent to their jurisdiction. Nothing here prevents you from bringing a claim in small-claims court.

13. CHANGES TO THESE TERMS

We may update these terms. The version posted at the time of your order applies to that order. Continued use of the site after changes means you accept them.
